What a caveat does in New Zealand

Under the Land Transfer Act 2017, a person who claims an estate or interest in land may lodge a caveat against dealings. A caveat can restrict registration of later dealings while it remains in force. It is not, by itself, a complete explanation of a loan or a substitute for a mortgage.

The right to lodge and maintain a caveat depends on the underlying legal interest. Improper use can have consequences. That is why borrowers and providers should rely on correctly prepared documents and legal advice, not a casual product label.

Questions to ask before proceeding

Ask whether the proposed security is a first mortgage, second mortgage, general security agreement, caveat-supported interest or another structure. Confirm what will be registered, who ranks ahead, what consent is required and how the security is discharged after repayment.

Also ask about repayment timing, enforcement rights, extension settings and the exact settlement process. These questions matter more than whether an advertisement calls the product a caveat loan.
